These Terms of Use ("Terms") govern your access to and use of the CA Wildfire mobile application (the "App") for iOS, published by Evgeniia Vorontsova, an individual developer based in Serbia ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Important safety notice. The App displays wildfire information for general awareness only. It is not an emergency service and must not be relied upon for life-safety decisions. Always follow instructions from local authorities and emergency services.

1. Eligibility

You must be at least the age of majority in your jurisdiction, or use the App under the supervision of a parent or legal guardian who agrees to these Terms. By using the App, you represent that you meet these requirements.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial use, in accordance with the Apple Media Services Terms and Conditions.

3. Acceptable Use

You agree not to:

Copy, modify, reverse-engineer, decompile, or create derivative works of the App, except where permitted by law;
Use the App for any unlawful purpose or in violation of any applicable law or regulation;
Interfere with, disrupt, or attempt to gain unauthorized access to the App, its servers, or the data sources it relies on;
Scrape, resell, or redistribute data obtained through the App in a way that violates the data providers' terms;
Use the App in any way that could damage, disable, or overburden it.

4. Wildfire Data and Accuracy

The App aggregates and displays wildfire, perimeter, and alert data from public and third-party sources. This information:

May be delayed, incomplete, inaccurate, or unavailable;
Is provided "as is" without any warranty as to accuracy, completeness, or timeliness;
Should never be your sole source of information during an emergency.

We do not control and are not responsible for third-party data sources.

5. Subscriptions and In-App Purchases

The App offers optional paid features ("Premium") via auto-renewable subscriptions and/or one-time in-app purchases processed by Apple through the App Store.

Billing. Payment is charged to your Apple ID account at confirmation of purchase.
Auto-renewal. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
Managing and cancelling. You can manage or cancel subscriptions in your Apple ID Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current billing period.
Prices. Prices are shown in the App before purchase and may vary by region and change over time. Any price change will apply only to future billing periods.
Refunds. Purchases are processed by Apple. Refund requests are handled by Apple in accordance with its policies; we generally cannot issue refunds directly. See support.apple.com/billing.

6. Intellectual Property

The App, including its design, code, text, and graphics (excluding third-party data and map imagery, which belong to their respective owners), is owned by us and protected by applicable intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.

7. Third-Party Services

The App relies on third-party services, including Apple (payments), public wildfire data providers, and map/tile providers. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE DATA IT DISPLAYS IS ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING RELIANCE ON WILDFIRE INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD 50, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by deleting it. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, provide notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of Serbia, without regard to its conflict-of-law rules. Any disputes shall be subject to the competent courts of Serbia, unless mandatory consumer-protection laws in your country of residence provide otherwise.

14. Apple-Required Terms

You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
